A quick summary for English-speaking readers: after the RIAA-style crackdown on its own market, Singaporean licensor ODEX is sending out e-mail threats to a French ISP regarding the download of French fansubs on a French BitTorrent tracker. Check out the mail here. I should mention that the series at stake, Ouran koukou hosuto-bu, is indeed unlicensed in France.

L'affaire ODEX à Singapour.

Si vous suiviez un peu la blogosphère animée anglophone l'été dernier, vous vous souvenez certainement de cette affaire qui a fait grand bruit chez nos amis de Singapour et au-delà. La société ODEX, principal distributeur d'animation japonaise à Singapour, décidait de frapper un grand coup en adressant à de nombreux internautes locaux repérés sur des trackers BitTorrent un courrier les enjoignant à s'acquitter de quelques milliers de dollars à titre de conciliation, faute de quoi ils s'exposaient à des poursuites judiciaires.

Les courriers en questions concernaient pour la plupart des titres dont ODEX détenait effectivement la licence d'exploitation pour Singapour, mais pas tous. Elle agissait sous la houlette de l'association AVPAS, fondée pour l'occasion, et qui a fait en sorte d'obtenir de certains éditeurs japonais (notamment la Toei) l'autorisation d'agir en leur nom pour faire respecteur leurs droits patrimoniaux sur le territoire.

On ne s'étonnera pas de la réaction globalement outragée de la communauté des fans d'anime, qu'ils soient impliqués ou non, à ce qui apparaissait à beaucoup comme un odieux chantage, et une méthode assez scélérate pour ODEX de sortir d'un marasme financier imputable à ses pratiques éditoriales et commerciales impopulaires.

En outre, à Singapour comme dans beaucoup de législations occidentales, les atteintes à la réglementation sur la propriété intellectuelle sont des délits pénaux, qui ne sont donc pas susceptibles de réglements à l'amiable avec les ayants-droits. L'offre de conciliation très lourde de l'AVPAS était donc probablement sans objet. Ce qui n'a bien sûr pas empêché beaucoup de payer rubis sur l'ongle (on a connu en France une affaire similaire, et c'était pareil).

Quoi qu'il en soit, l'image médiatique d'ODEX a certainement été ternie par ces procédés douteux. Lorsque le fournisseur d'accès Pacific Internet a remporté son procès en première instance contre ODEX qui exigeait la divulgation des informations personnelles des internautes apparaissant sur ses relevés d'IP, les défenseurs des libertés individuelles (plutôt malmenées à Singapour) y ont vu une victoire pour la protection de la vie privée. Ils attendent à présent le verdict de la cour d'appel.

Pour le reste, aucune procédure n'a à ce jour été lancée contre les internautes fichés par ODEX, qu'ils aient déboursé leurs $3000 ou non. Et la blogosphère de Singapour, qui avait été très secouée par l'événement, semble avoir repris son activité normale.

L'affaire ODEX en France?

Personne n'imaginait sans doute voir ODEX agir en dehors de la cité-état, mais un message très surprenant de Club-Internet, adressé à l'un de ses abonnés, vient nous faire douter.

Ce qui vous attend, visionneurs de fansubs?

Est-ce une simple erreur du chasseur de primes BayTSP, les espions-sur-BitTorrent commandités par ODEX, ou y a-t-il une volonté réelle du distributeur singapourien d'étendre ses menaces au monde entier? Vous voici juges (via les forums de Nerae) :

Bien entendu, il paraît totalement invraisemblable qu'une procédure pénale soit lancée chez nous sur la foi d'une dénonciation formulée par un distributeur de Singapour grâce à des données recueillies par une société californienne, au sujet d'une série aux ayants-droits japonais et dont les droits de distributions ne sont pas délégués en France. Mais enfin, c'est amusant d'imaginer ODEX jouer les justiciers planétaires de l'animation japonaise (ou user de procédés d'extorsion à l'échelle planétaire, c'est selon).
